Justice Prevails: Rescuing Children from Forced Labor
 

This is a classic case of debt bondage in which Abid Chattah, the owner of the brick kiln Kudwala Bangla, and his supervisor, Muhammad Rafique, forced Mohammad Baksh's children into bonded labor in Tehsil Yazman in order to collect his debt.


Mohammad Baksh, son of Rajab Ali, is a 51-year-old resident of Shah Rukn-e-Alam, Multan has three children: A. B. (6 years old), N. B. (7 years old), and C. B. (8 years old). The brick kiln owner and supervisor accused Mohammad Baksh of taking a loan and abandoning his work at their brick kiln. As a result, they had his children to work forcefully to repay the debts. Initially, Baksh sought legal assistance, but due to inadequate handling by his lawyer and the influence of powerful brick kiln owners, his case was dismissed, and the court ordered him to repay the debts owed to the brick kiln owners.


Subsequently, Baksh sought help from the Society for the Protection of the Rights of the Child (SPARC) and enlisted the support of Advocate Naureen Malik, affiliated with the High Court Multan and part of the SPARC lawyer panel. Malik filed a case on December 5th, 2023, in the court of Justice Muhammad Amjad Rafiq (Case No. 5168-H-23). The plea emphasized that the children were in their custody, urging the court to direct the Station House Officer (SHO) of the Yazman police station to produce the children in court.


The judge issued a one-day notice, instructing the SHO to present the children in court on December 7th, 2023. Simultaneously, Advocate Naureen Malik contacted the Advocate General and the District Police Officer (DPO) to ensure that the police were not influenced by the powerful brick kiln owners. Malik coordinated efforts on December 6th to keep the police, DPO office, and Advocate General updated, ensuring the children appeared before the judge as directed on December 7th.


The police successfully recovered the children on the night of December 6th, and they were kept in the police station to be presented before the judge. On December 7th, when Mohammad Baksh arrived at the court, the police kept him waiting outside, causing concern about a potential recurrence of events. However, after the hearing, the judge ordered the release of the children to Mohammad Baksh under the provisions of Section 491 CR.P.C.
